HEARING ON MOTION TO SUPPRESS EVIDENCE, BY DEFENDANT GERTRUDE BANISZEWSKI,
OUT OF PRESENCE OF THE JURY.

MELVIN D. DIXON , a witness called on behalf of the defendant Gertrude Baniszewski,
being duly sworn by the Court, testified as follows:

DIRECT EXAMINATION (OUT OF PRESENCE OF THE JURY),
QUESTIONS BY MR. WILLIAM ERBECKER, ATTORNEY FOR DEFENDANT,
GERTRUDE BANISZEWSKI

Q. State your name, please.

A. Melvin D. Dixon.

Q. You are the same police officer who testified yesterday in this Motion to Suppress?

A. Yes, sir.

Q. Now, just a few omitted questions I may have omitted. At the time you visited the premises there of the home of Gertrude Baniszewski on October 26, 1965, did you have a warrant?

A. No, sir.

THE COURT: That was brought out yesterday, there was no warrant. It was all brought out yesterday.

MR. ERBECKER: By me? I am trying to make a record.

THE COURT: Go ahead, duplicate the record, it is alright.

MR. ERBECKER: If the Court, thinks it is not necessary.

THE COURT: It is up to you. The Court is not restricting you. Repetition has to stop somewhere. Go on, ask all the questions.

MR. ERBECKER: No further questions.

THE COURT: The Court takes judicial knowledge of the evidence he heard yesterday, the manner of which the witness entered the premises from the evidence in the record, all the evidence in the record.

MR. ERBECKER: With particular reference to defendant Gertrude Baniszewski?

THE COURT: All the defendants. Next witness, or continue with witness.

MR. ERBECKER: The Court indicated it did not want to hear any more evidence.

THE COURT: No, the Court indicated there was no sense in repetition.

MR. ERBECKER: Gertrude Baniszewski has no more questions.

THE COURT: Alright, next witness, please.

WITNESS EXCUSED.

MR. ERBECKER: Police Officer Harmon, please.
