WITNESS SWORN BY THE COURT.

HIRAM T. SEXSON , a witness called on behalf of defendant Gertrude Baniszewski,
being duly sworn by the court, testified as follows:

DIRECT EXAMINATION,
QUESTIONS BY MR. WILLIAM ERBECKER, ATTORNEY FOR DEFENDANT,
GERTRUDE BANISZEWSKI

Q. State your name, sir.

A. Hiram T. Sexson.

Q. What is your business or profession?

A. I am a physician.

Q. Where is your office?

A. 3731 North Keystone.

Q. How long have you been a practicing physician, Doctor?

A. Since 1942.

Q. What college did you graduate from?

A. Indiana University Medical School.

Q. Do you know the defendant in this case, Gertrude Baniszewski?

A. I don't remember, but I do have a chart on her, yes.

Q. Do you have the chart?

A. Yes.

Q. Refresh your recollection as to the first time you saw her and the last time.

MR. NEW: At this time we ask leave to ask a question.

THE COURT: Alright.

PRELIMINARY QUESTIONS,
BY MR. LEROY NEW,
DEPUTY PROSECUTOR

Q. Dr. Sexson, how are you?

A. Fine.

Q. Have you seen Mrs. Baniszewski more recently than eight or nine years ago?

A. The last time I saw her was 1957.

MR. NEW: We object on the grounds it is too remote.

THE COURT: You object to the question instead of further testimony.

DIRECT EXAMINATION RESUMED,
QUESTIONS BY MR. WILLIAM ERBECKER, ATTORNEY FOR DEFENDANT,
GERTRUDE BANISZEWSKI

Q. Doctor, in 1957 did you treat the defendant?

A. Yes.

Q. What did you treat her for?

MR. NEW: We object.

THE COURT: Overruled.

A. I delivered a baby.

Q. Did you treat her?

A. I delivered her baby.

Q. Did you treat her for anything else?

A. Yes, sir.

Q. What did you treat her for?

A. I have only part of the chart. I keep charts approximately five years but on this last page I have approximately three things I treated her for. The first of June for a rash on her back and abdomen and face, which was nothing, possibly allergy. I treated her next for - she had asthma at that time and I saw her the 17th of June for an asthma attack and bronchitis. Then July, I also treated her for a vaginal problem.

Q. What?

A. Vaginal - she had a vaginal discharge and I treated her August, 1957 because of her asthma and bronchitis. September 1957, I treated her because she stated she had been very jittery lately. Those are the times I saw her in '57.

Q. September she was jittery?

A. Yes, that was her complaint, she was very jittery.

Q. Did you give her anything?

A. Yes, Miltown, a quarter grain daily.

Q. What?

A. Miltown.

Q. What is that, Doctor?

A. Meprobamate.

Q. It does what, induce sleep?

A. No, it calms the patient down.

Q. Did you observe her appearance at that time?

MR. NEW: We object.

THE COURT: Sustained.

MR. ERBECKER: Nothing further.

THE COURT: Cross examination?

MR. NEW: No, Your Honor.

THE COURT: Any of the defendants?

MR. ERBECKER: I have an omitted question.

DIRECT EXAMINATION (OMITTED QUESTIONS),
BY MR. WILLIAM ERBECKER, ATTORNEY FOR DEFENDANT,
GERTRUDE BANISZEWSKI

Q. Did you see her after September 1957?

A. I saw her in October with a cold. I mean she had problems at that time with the bronchial tree and had asthma and bronchitis quite frequently.

Q. Any after that?

A. No.

Q. October, '57, did you prescribe anything for bronchitis?

A. October - did I prescribe, yes, sir.

Q. What?

A. I gave her an antibiotic, acromycin, and told her to continue the capsules I had given her in June for her asthma.

Q. What was it, chronic asthma?

A. Yes.

Q. Is that the last time you saw her?

A. That is the last time I have a record.

THE COURT: Any cross?

MR. NEW: No.

THE COURT: Any questions from the others?

MR. BOWMAN: No.

MR. RICE: No.

MR. NEDEFF: No.
