WITNESS SWORN BY THE COURT.

HELEN BRAND , a witness called on behalf of defendant John Stephan Baniszewski,
being duly sworn by the court, testified as follows:

DIRECT EXAMINATION,
QUESTIONS BY MR. FORREST BOWMAN, ATTORNEY FOR DEFENDANTS,
COY HUBBARD AND JOHN STEPHAN BANISZEWSKI

Q. State your name.

A. Helen Brand.

Q. What is your occupation?

A. Recreational Assistant at the Juvenile Center.

Q. Are you married, Mrs. Brand?

A. Yes.

Q. What is his occupation?

A. Superintendent.

Q. Of the Juvenile Center at 25th and Keystone?

A. Right.

Q. How long have you worked there?

A. Six and a half years.

Q. What sort of work do you do?

A. Well, mostly I work with kids.

Q. And when you are working with the kids out there, did you have occasion to meet John Baniszewski?

A. Yes, sir, I have.

Q. Did you work with him?

A. Yes, sir.

Q. What sort of work did you do with him?

A. Oh, I usually go in John's unit, Unit 2.

Q. What is Unit 2?

A. Unit 2 is what we refer to as the younger boys at the Juvenile Center. I go in with maybe the record player, games, color books, this sort of activity.

Q. You organized recreation for them?

A. Yes.

Q. Did you have occasion to see John from time to time since they brought him out there from the Marion County Jail?

A. Yes, sir, I have.

Q. How did John behave?

MR. NEW: We object. It is a conclusion. She can state what he does.

THE COURT: Objection sustained to the form.

Q. Did John misbehave out there?

MR. NEW: We object.

THE COURT: Sustained.

Q. Was John a disciplinary problem?

MR. NEW: We object.

THE COURT: Sustained.

Q. Ma'am, let me say that John's mother testified she could not control him. Can you?

A. We have no difficulty controlling John, no, sir.

MR. BOWMAN: Thank you. You may cross.

MR. NEW: No questions, Your Honor.

THE COURT: Defendant Gertrude Baniszewski.

CROSS EXAMINATION,
QUESTIONS BY MR. WILLIAM ERBECKER, ATTORNEY FOR DEFENDANT,
GERTRUDE BANISZEWSKI

Q. You don't have six children of your own to contend with at the same time and two neighbor children to contend with at the same time. You don't have jurisdiction over them out there either, do you?

A. I usually work with twenty-four to thirty-two children in a group.

MR. ERBECKER: Read the question to her.

THE REPORTER READ THE LAST QUESTION.

A. I don't understand the question.

THE COURT: Next question, please.

MR. ERBECKER: Your Honor, I would like to get a yes or no answer.

THE COURT: While you are looking after John, do you have six children of your own, simultaneously and two neighbor children to contend with while you supervise John? Do you?

A. You mean are my children at the Juvenile Center? I don't quite understand what you are asking me.

MR. ERBECKER: Read the question.

THE COURT: It has been read. You restate the question so she will understand it.

Q. While you are supervising John out there, are you also supervising six children of your own, Ma'am, and two neighbor children?

A. No, I don't have six children.

Q. Your answer is no?

A. That is true.

THE COURT: Any other questions?

MR. ERBECKER: No, sir.

THE COURT: Paula Marie Baniszewski?

MR. RICE: We have no questions of this lady.

THE COURT: Richard Hobbs may cross.

Q. Do you enjoy your work there at the Center?

A. Yes, I do.

THE COURT: Defendant Coy Hubbard may cross.

MR. BOWMAN: No questions.

THE COURT: Anything from the State?

MR. NEW: No questions.
