MR. BOWMAN: I have one witness for Coy Hubbard that will take five minutes.

THE COURT: Coy Hubbard may present his evidence.

WITNESS SWORN BY THE COURT.

JAMES MOORE , a witness called on behalf of the defendant Coy Hubbard,
being duly sworn by the court, testified as follows:

DIRECT EXAMINATION,
QUESTIONS BY MR. FORREST BOWMAN, ATTORNEY FOR DEFENDANTS,
COY HUBBARD AND JOHN STEPHAN BANISZEWSKI

Q. State your name.

A. James Moore.

Q. Where do you live, sir.

A. At 1343 North Edmondson.

Q. What is your occupation?

A. I am a restaurant manager.

Q. What restaurant do you manage?

A. Laughner's Cafeteria.

Q. On East 10th?

A. About 5100 East 10th.

Q. How long have you been there?

A. Approximately a year.

Q. Do you know Coy Hubbard?

A. Yes.

Q. How did you become acquainted?

A. He was an employee of the restaurant, bus boy and dish washer.

Q. About what times would you say he worked?

A. Normally 4:30 till 8:30.

Q. Was that after school?

A. Yes, sir.

Q. Do you remember October 27, when he was arrested?

A. Yes, sir.

Q. Do you remember what day of the week that was?

A. That was on Wednesday.

Q. Had he worked Monday and Tuesday before that Wednesday?

A. Yes, sir.

Q. How late did he work?

A. Around 8:30.

Q. Around 8:30 both of those nights?

A. Yes, sir.

Q. Was he a pretty good worker for you?

A. Yes, sir.

Q. Did you ever have any trouble with him?

A. No, sir.

MR. BOWMAN: You may cross.

Q. Do you know if Coy Hubbard went to school on Monday, October 25?

A. No, sir, I don't.

Q. Do you know if he hit a girl named Sylvia Marie Likens with a broom, on the head, on that date?

A. No, sir.

MR. NEW: That is all.

THE COURT: Gertrude Baniszewski?

MR. ERBECKER: No questions.

THE COURT: John Stephan Baniszewski?

MR. BOWMAN: No questions.

THE COURT: Defendant Paula Marie Baniszewski?

MR. RICE: No questions.

THE COURT: Defendant Richard Hobbs?

MR. NEDEFF: Defendant Richard Hobbs has no questions.

WITNESS EXCUSED.

MR. BOWMAN: Coy Hubbard rests.

DEFENDANT COY HUBBARD RESTS.

THE COURT: Alright, now does any other defendant, before we give a recess to Richard Hobbs, have anything to present at this time? Ladies and Gentlemen of the Jury and Alternate Jurors, retire for five minutes. During the recess, don't talk among yourselves and don't let anyone talk to you about this case or any subject connected therewith. Don't form or express any opinion on it till the case is finally submitted to you. Jury and Alternate Jurors may retire.
